2. Applicability

These Terms & Conditions apply to every offer, order and agreement
between LuxuryToys and a consumer through luxurysextoys.nl.

Before completing an order, customers have the opportunity to read
these Terms & Conditions and save or print them for future reference.

3. Products and product information

We aim to describe and display our products as accurately as reasonably possible.
Product photographs are intended to give a realistic impression of the product.
Colours may appear slightly different depending on the screen or device used.

Obvious errors in descriptions, prices or other product information do not bind LuxuryToys.

4. Prices

Prices displayed to consumers include applicable VAT unless expressly stated otherwise.

Any applicable shipping costs are shown separately before the customer completes the order.
LuxuryToys currently does not offer free shipping.

5. Ordering

An agreement is concluded when the customer places an order through the webshop
and LuxuryToys electronically confirms that order.

After placing an order, the customer receives an order confirmation by email.

In the event of an obvious pricing error, technical error, suspected fraud,
or a product that can no longer reasonably be supplied, LuxuryToys may cancel the order.
Any amount already paid for a cancelled order will be refunded.

6. Payment

Available payment methods are shown during checkout.
LuxuryToys currently accepts iDEAL | Wero through the payment service available in the webshop.

The order will only be processed once the required payment has been successfully authorised.

7. Delivery area

LuxuryToys currently delivers only to addresses in:

• The Netherlands
• Belgium

Orders are shipped using PostNL.

8. Delivery times

The delivery time shown for a product at the time of purchase is the expected delivery time.
Delivery times are estimates unless a specific delivery date has expressly been agreed.

If an unexpected delay occurs, we will inform the customer where reasonably possible.

9. Shipping costs

The applicable shipping cost is clearly displayed during checkout before the order is completed.

Shipping rates may be updated when carrier rates change.
The amount shown during checkout at the time of purchase is the amount applicable to that order.

10. Right of withdrawal

Consumers generally have a statutory right to withdraw from an online purchase
without giving a reason.

The withdrawal period ends 14 days after the day on which the consumer,
or a third party designated by the consumer, receives the product.

Where several products from one order are delivered separately,
the period starts after receipt of the last product.

A consumer may also notify LuxuryToys of the withdrawal before delivery has taken place.

Withdrawal can be exercised using the online withdrawal function on our website,
by email, by post, or by using the statutory model withdrawal form.

11. Sealed hygiene products

Some products sold by LuxuryToys are products for which health protection
and hygiene are important.

The customer may inspect the product while the hygiene seal remains intact.
Opening the outer shipping parcel itself does not remove the right of withdrawal.

LuxuryToys only relies on this hygiene exception where the product was actually supplied sealed
and the customer was informed before purchase that breaking the seal removes the right of withdrawal.

12. Returning products after withdrawal

After informing LuxuryToys of the withdrawal, the consumer must return the product
within 14 days.

For a normal withdrawal because the customer has changed their mind,
the direct cost of returning the product is paid by the customer.

The product should be packaged carefully.
We recommend retaining proof of shipment until the return has been processed.

During the withdrawal period, a consumer may handle a product only to the extent
reasonably necessary to determine its nature, characteristics and functioning.
If the product has been handled beyond what is necessary and loses value as a result,
LuxuryToys may deduct that loss in value where permitted by law.

13. Refunds after withdrawal

When a consumer validly withdraws from the entire order,
LuxuryToys refunds the purchase price of the returned products
and the original cost of the standard delivery method.

If the customer selected a more expensive delivery method,
LuxuryToys is only required to refund the cost of the standard delivery method.

If only part of an order is returned, the original delivery costs do not have to be refunded.

Refunds are made no later than 14 days after we receive the withdrawal notice.
We may wait with the refund until the returned goods have been received,
or until the customer provides evidence that the goods have been sent back,
whichever occurs first.

Refunds are normally made using the same payment method used for the original purchase,
unless another method is expressly agreed.

14. Defective or incorrectly delivered products

If a product is defective, damaged or incorrectly delivered,
please contact LuxuryToys before returning the product.

We will provide appropriate return instructions.

If the customer pays reasonable return shipping costs following our instructions,
those costs will be reimbursed after the returned product has been received and assessed.

Nothing in these Terms limits the consumer’s statutory rights relating to conformity,
repair, replacement or other remedies available under applicable law.

Please include the order number and enough information for us to investigate the complaint.
We will respond within a reasonable period.

Personal data is processed in accordance with our Privacy Policy.

17. Intellectual property

Unless otherwise stated, original website text, design, branding and other content
on luxurysextoys.nl may not be copied or commercially reused without permission
from the relevant rights holder.

Product photographs, trademarks and brand names may belong to their respective
manufacturers, suppliers or other rights holders.

18. Liability and product use

Products must be used in accordance with their intended purpose,
product instructions and safety information.

LuxuryToys is not responsible for damage resulting from improper use,
use contrary to provided instructions, or use for a purpose for which
a product was not intended.

Nothing in these Terms excludes or limits liability where such an exclusion
or limitation is prohibited by law.

19. Changes to these terms

LuxuryToys may update these Terms & Conditions from time to time.

The terms applicable to an order are the terms made available to the customer
when that order was placed.

20. Applicable law

Agreements with LuxuryToys are governed by Dutch law insofar as legally permitted.

Mandatory consumer protection rights applicable to consumers remain unaffected.
